The following conditions regulate the information and permitted use of websites within the domain https://viapirinenca.cat (hereinafter “the Website”), the proprietors of which the Catalan National Assembly, hereinafter ANC, with registered offices at Carrer de la Marina, 315, 08025, Barcelona, with CIF Tax ID G65581621, and registered in the Registry of Associations and Federations of Catalonia with registration number 46548-J/1 in compliance with Law 34/2002, of July 11th, of the Information Society Services and Electronic Commerce, and the Federation of Hiking Organizations of Catalonia, hereinafter FEEC, with registered offices at La Rambla, 41 Principal, 08002 Barcelona, with CIF Tax ID G- 58134081, registered in the Registry of Sports Entities of the Generalitat de Catalunya with number 1425, and Gure Esku Dago, with offices at Erdiko kalea 23, 20500, Arrasate (Gipuzkoa), and with CIF Tax ID G75116491, make available to members, supporters, and other Internet users.

 

The website has been created and designed in order to publicize the “Pyrenean Way” act of protest.

The purpose of these general conditions is to regulate the access and use of the Website that the ANC, the FEEC and Gure Esku make available, free of charge, to users interested in their activities, except for the cost of the connection through the telecommunications network provided by the access provider contracted by the Internet user.

 

Access to and navigation on the Website implies acceptance, without reservation, of all the conditions included in this document.

The Internet user is required to make proper use of the Website in accordance with current Spanish and European legislation and under the conditions included herein. The Internet user shall be liable to the ANC, the FEEC, Gure Esku or other third parties for any damage and/or harm that may be caused as a result of the breach of these obligations.

 

 Use of the Website for purposes detrimental to the property or interests of the ANC, FEEC, Gure Esku or third parties, or in any way to overload, damage or disable networks, servers, or other computer equipment (hardware) or products and computer applications (software) of the ANC, FEEC, Gure Esku or third parties is expressly forbidden.

 

The ANC, the FEEC and Gure Esku reserve the right to make, at any time and without prior notice, modifications and updates to the information contained on the Website, its configuration and presentation and the Conditions of Use.

 

The provision of the Web service is limited to the time during which the Internet user is connected to the same or to any of the services provided through it. It is therefore recommended that Internet users read these Terms of Use carefully and thoroughly on each occasion they intend to enter and use the Website, as these may be subject to change.

 

The ANC, the FEEC and Gure Esku do not guarantee that there will be no interruptions or failure in accessing the Website or its content, nor that such content is kept up to date. The ANC, the FEEC and Gure Esku will carry out all those tasks necessary to resolve failures, restore communication, and update content, in the absence of causes that make it impossible or difficult to execute such tasks, and as soon as they become aware of failures, loss of connection or lack of updates in the contents.

 

Both access to the Website and any unauthorized use that may be made of the information contained therein are the sole responsibility of the person who makes such access or use.

 

The ANC, FEEC and Gure Esku shall not be liable for any consequence, damage or loss that may arise from such access or use. The ANC, FEEC and Gure Esku are not responsible for any security flaws that may occur, or for any damage that may occur to the Internet user’s computer system (hardware and software), or to the files or documents stored therein, as a result of the presence of malicious software on the Internet user’s computer that is used to connect to the contents of the Website, a malfunction of the browser, or as a result of using outdated browser versions.

 

The ANC, the FEEC and Gure Esku do not assume any responsibility arising from the contents linked from the Website and not associated to it, nor do they guarantee the absence of malicious software or other elements in them that may cause alterations to the computer system (hardware and software), or to the documents or files of the Internet user. The ANC, the FEEC and Gure Esku shall not be held liable for damages of any kind caused by any such reason.

 

If any Internet user considers that the content or services provided by the linked websites are unlawful or infringe on the property or rights of the Internet user or a third party liable for damages and in particular, they consist of:

  • activities or content that endanger the protection of public health, respect for human dignity and the principle of non-discrimination and the protection of health and children.

  1. Procedure in case of unlawful activities

If an Internet user considers that there are facts or circumstances that reveal the unlawful nature of the use of any content and/or the performance of any activity on the Website, and in particular, the infringement of intellectual property rights or industrial rights (patents, models and industrial designs, trademarks, and commercial names, etc.) or other rights, the user shall send a notification to the ANC with the following content:

The intellectual property rights of the Website are the property of the ANC, the FEEC and Gure Esku, who are responsible for the exclusive exercise of the exploitation of such rights, including reproduction, distribution, public communication, and transformation. These rights include software, source code, graphic design, navigation structure, databases, text, photographs, and images, and in general all content and elements contained therein. Similarly, trademarks, commercial names, or distinctive signs are the exclusive property of ANC, FEEC, and Gure Esku, or  third parties, unless otherwise specified.
